The Charter Party Workshop Masterclass Online is a series of 10 online sessions and combines a range of lecturers on voyage and time chartering with sessions on related day-to-day issues and troubleshooting. Each day will run for 2 x 75 minutes with a short break in between the sessions.

COMMON ISSUES

Overview of the inter-relationship between the contract of sale, the charter party, the bill of lading and the insurance certificate.

VOYAGE CHARTERS

The shipowner’s duties: to provide a seaworthy ship, to care for the cargo properly and carefully, to proceed with reasonable dispatch, cancellation clauses, deviation, and slow steaming clauses.

VOYAGE CHARTERS

Laytime and demurrage: NOR validity, types of laytime, when does laytime start to run? What suspends laytime? When does laytime stop? Demurrage, damages for detention, time bar clauses.

VOYAGE CHARTERS

The charterer’s duties: full and complete clean and sound cargoes, payments of, freight/deadfreight, port nominations, to provide all port restrictions (draft, air draft, etc) at the loading and discharging ports before fixing.

Employment orders: employment vs. navigation and safety, orders which a master must refuse, orders which a master has the right to refuse.

Time charter cargo operations: Who is responsible for cargo operations? the effect of various clauses. Stevedore damage issues, effect of the Inter-Club Agreement.

Time charter duration and re-delivery: overlap/underlap, illegitimate last voyages, express and implied tolerances, last voyage clauses, “without guarantee”.

Payment of hire: payment on time, allowed deductions, methods of payment, methods of payment of value of bunkers at delivery, remedies for non-payment of hire, withdrawal of ship from charterers’ service, anti-technicality clauses, suspension of service.

Off-hire clauses: general principles, the effect of different types of clauses, the importance of the wording, off-hire computation (per hatch/crane/gang).

COMMON ISSUES

Dangerous cargo: What is “dangerous”? When does notice need to be given? The basis of “liability” under the Hague and Hague-Visby Rules. Who is liable?

Safe ports: What is a safe port? When is a port to be safe? What is the extent of the charterers’ duty?

Course certification

Participants will be given an option of taking a final assessment (open-book test) at the end of the course, and Certificate of Achievement will be issued with a grade (distinction, merit or pass). Those not taking the assessment will receive a Certificate of Attendance.

BIMCO issues electronic course files as an Adobe PDF file enabling you to make personal notes. All documentation and presentations will be in English. Course access details will be provided once the registration is completed.
