Specifically, we will highlight BIMCO's efforts to develop practical clauses that address the implications of the FuelEU Maritime Regulation, part of the EU’s “Fit for 55” package, which aims to reduce greenhouse gas emissions by 55% by 2030.

This regulation presents significant challenges and opportunities for shipowners and operators. To tackle these challenges, BIMCO has established a dedicated subcommittee to examine the FuelEU Maritime Regulation and develop relevant clauses. The subcommittee's goal is to create practical contractual solutions that facilitate compliance. Currently, it has developed a clause for time charter parties and another for SHIPMAN. Moreover a need for developing a clause addressing FuelEU Maritime for MOAs has been identified and also more specific terms related to certification and the pooling mechanism introduced by the regulation are currently being considered. The FuelEU Maritime has the potential to significantly impact the shipping industry, possibly even more than the EU Emissions Trading System (ETS), requiring stakeholders to align their contractual frameworks ahead of the regulation's enforcement in 2025. 

During the seminar, the content of the FuelEU clauses will be discussed. They have been designed to enable compliance and clarify responsibilities in time charter parties and ship management agreements. Participants will gain insights into key contractual considerations, including risk management and compliance mechanisms. Each session will conclude with an open Q&A, providing a platform for discussing best practices and strategies for aligning contractual frameworks with evolving regulatory requirements. The Q&A will be conducted via Zoom chat.

Session 1: Overview of FuelEU and Its Impact on Maritime Transportation

Duration: 90 minutes

Objective: To equip participants with a commercial understanding of the FuelEU Maritime Regulation, its goals, and its implications for the maritime industry.

  • Scope of the regulation: applicability to vessels over 5,000 GT and specific operational requirements

Reduction Targets and Compliance

  • Discussion of reduction targets (2% reduction in 2025, up to 80% by 2050)
  • Responsibilities for compliance: role of the ISM company
  • Overview of compliance mechanisms (certified fuels, banking surpluses, pooling, and penalties)

Additional Regulatory Requirements

  • Introduction to the additional requirements for zero emissions at berth from 2030
