War risks subcommittee London meeting September 2023

Initial draft of CONWARTIME 2013 now ready

The subcommittee held a productive meeting at West P&I's London offices and the dedicated drafting team has successfully concluded the initial draft of the War Risks Clause for Time Chartering (CONWARTIME). 

BIMCO's dedicated subcommittee, tasked with reviewing the War Risks Clauses including the BIMCO War Cancellation Clause 2004, the BIMCO War Risks Clause for Time Chartering 2013 (CONWARTIME 2013), and the BIMCO War Risks Clause for Voyage Chartering 2013 (VOYWAR 2013), has completed the initial draft of CONWARTIME. 

This milestone marks the advancement in our ongoing quest to enhance and streamline BIMCO's War Risks Clauses, which includes the BIMCO War Cancellation Clause 2004, CONWARTIME 2013, and the BIMCO War Risks Clause for Voyage Chartering 2013 (VOYWAR 2013).  

The subcommittee convened in London, where we had the opportunity to meet with the members in person for an in-depth discussion regarding the clause. This session was made possible thanks to the hospitality of West P&I and our dedicated subcommittee member, Nicola Cox.  

Under the proficient leadership of Michiel Starmans (Spliethoff), the subcommittee, consisting of a dedicated team of industry experts including Dirk Janssen (Nordisk), Dorte Nielsen (Centurion Bulk), Henning Babiel (ADM), Neil Roberts (Joint War Committee), Nicola Cox (West P&I), Richard Neylon (HFW), Richard Young (Beazley), our director Stinne Taiger Ivø and colleagues Carl Lindahl and Dorte Bisgaard (Kjaergaard-Jensen), has successfully drafted CONWARTIME. 

Throughout this process, the subcommittee has engaged in enriching and informative discussions, covering a wide range of topics from grammatical refinements to legal subtleties and commercial implications, with a particular focus on additional premiums and transparency between the parties. 

The initial draft is now set for a review during the forthcoming meeting of the BIMCO Documentary Committee, scheduled on 11 October. The Documentary Committee review is set to take place shortly, with the project's completion targeted for early 2024.
