Why was GENCON 2022 developed?
The revision of GENCON 1994 was needed as it was no longer reflective of commercial and legal requirements for both ships and cargoes.
In most cases, a vast number of rider clauses get added to a charter anyway to fulfil the needs of the commercial parties. Now BIMCO has done the job for them. This should be of great help to those companies who may not necessarily have an internal legal department they can turn to for assistance.
Many charterers have considered GENCON 1994 to be a rather owner-friendly charter. A key development of GENCON 2022 is the balancing of the owners’ and the charterers’ rights and obligations in a fair and equitable manner.
